I think it is illegal or actionable, but difficult to enforce. You are allowed a copy of an outtake, but not allowed to distribute it. They have set up a network that disguises the intent to distribute.
In the case of a Roky Eriksson, he is likely better served by this than getting it shut down. Promotion is non-existant for most of the lesser-known artists, and any exposure he can get benefits him more than tight IP enforcement. In concert sales and the tiny royalties he gets from commercial product. Roger McGuin and Janis Ian both have websites discussing the issue.

I loved it when the opening sequence of High Fidelity showed a needle dropping and then the opening chords of that song rang out. I remember thinking, finally, I'm part of a movie's target audience.
